THE FOLLOWING ARE THE OFFICIAL TERMS AND CONDITIONS (“TERMS”) APPLICABLE TO THE STEDFAHST ENTREPRENEUR EXPLORATORY DISCOVERY SURVEY AND INTERVIEW PROGRAM (“SURVEY”) BETWEEN DAVID LEE MATTHEWS (“INVESTIGATOR”) AND THE PARTICIPANT (“PARTICIPANT” “ENTRANT” “YOU”). SURVEY PARTICIPATION IS ONLY OPEN TO LEGAL RESIDENTS OF THE UNITED STATES OR THE DISTRICT OF COLUMBIA WHO ARE 18 YEARS OF AGE OR OLDER AT THE TIME OF ENTRY AND MEET THE ELIGIBILITY REQUIREMENTS UNDER SECTION 3 BELOW. VOID WHERE PROHIBITED BY LAW.
BY PARTICIPATING, YOU AGREE THAT YOU HAVE READ AND AGREE TO THESE TERMS. IF YOU DO NOT WISH TO AGREE TO THESE TERMS, DO NOT PARTICIPATE IN THE SURVEY.
Introduction. The Survey is an independent and anonymous research project in which Participant(s) will submit answers to either a survey or a recorded interview with the Investigator related to the Participant’s entrepreneurial pursuits, their personality, and early life experiences.
Entry Period: Eligible Participant(s) may participate in the Survey by taking the Survey at https://www.stedfahst.com (“Website”). To be eligible to participate in the Survey, the Investigator may require that entries are received within the specified entry period stated on the Website.
Eligibility: To be eligible to participate in the Survey, you must meet all of the eligibility requirements below:
a. You must be 18 years of age or older
b. You must have been the sole owner or partner in a entrepreneurial venture;
Survey Responses : By participating in the Survey, you hereby assign to the Investigator all right, title, ownership, and interest in all of your Survey responses (“Survey Responses”). You authorize the Investigator to use the Survey Responses in statistical analysis and present the results in a report. This authorization extends to all languages, media, formats, and markets now known or later discovered.
Conditions and Code of Conduct for Participation: By participating in this Survey, You represent and warrant (i) to comply with all applicable federal, state, and local laws and regulations; (ii) that any answers You provide or submit do not infringe the intellectual property rights any of any other party, (iii) your participation will not violate any privacy or publicity or other proprietary rights of any person or entity; (iv) that your answers will not contain any obscene, offensive, libelous, disparaging, infringing, or other inappropriate content or subject matter; and (v) that you will keep your participation in the Survey and the Survey questions and all other aspects of the Survey confidential.

General Conditions and Release: Your answers or submissions must not disclose any confidential information, trade secrets, patentable subject matter, any account information or other personal data at any stage of the Survey. By participating in the Survey, You (a) release, discharge and hold harmless the Investigator from any and all liability for any claims, costs, injuries, losses or damages of any kind arising out of the your participation in the Survey or related activities, including any violation of these Terms and the unauthorized or illegal access to personally identifiable or sensitive information ; and (b) acknowledges that Released Parties have neither made nor are in any manner responsible or liable for any product liability, warranty, representation or guarantee, expressed or implied, in fact or in law, related to the Incentives including, but not limited to, its performance, or availability. Neither the Released Parties nor any service providers of the Released Parties are responsible for lost, incomplete, illegible, late, damaged, inaccurate, misdirected, garbled, or undelivered submissions or email; miscommunications, failed computer hardware or software or technical failures; printing, typographical or other errors appearing within the Terms, in any Survey related announcement or other materials; or other errors or problems of any kind relating to or in connection with the Survey, including, without limitation, errors or problems which may occur in connection with the administration of the Survey related to scheduling, the processing of entries, mail or e-mail, or any injury or damage to You or any other persons’ computers or equipment related to or resulting from participation, or uploading or downloading of any materials related to this Survey. Any materials provided to participants by the Investigator is solely to facilitate participation in the Survey on an AS IS basis without warranties of any kind.
The Investigator’s failure to enforce any term of these Terms shall not constitute a waiver of such term or provision. If for any reason the Survey is not capable of being executed as planned, due to tampering, unauthorized intervention, fraud, technical failures or any other causes which in the opinion of the Investigator, corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Survey, the Investigator reserves the right at its sole discretion to void content submitted on your behalf and to cancel, terminate, modify or suspend the Survey (or any portion thereof) for any reason.
Disputes: You agree that (a) any and all disputes, claims and causes of action arising out of, or connected with, the Survey or the award of Incentives shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the District of North Carolina or the appropriate North Carolina State Court located in Wake County, North Carolina; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Surveys but in no event attorneys’ fees; and (c) under no circumstances will You be permitted to obtain awards for, and You hereby waive all rights to, claim punitive, incidental and consequential damages and any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms, your rights and obligations, or the rights and obligations of the Investigator in connection with the Survey, shall be governed by, and construed in accordance with, the laws of State of North Carolina, without giving effect to any choice of law or conflict of law rules (whether of the State of North Carolina or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than State of North Carolina.
Agreement to Terms: By participating in the Survey, You agree to abide by and be subject to these Terms and the Investigator’s decisions, which are fully and unconditionally binding in all respects. The Investigator reserves the right to refuse, withdraw, or disqualify any participant at any time at the the Investigator’s sole discretion. By participating in this Survey, You represent and warrant that You are eligible to participate based on eligibility requirements explained in these Terms. You also agree to accept the decisions of the the Investigator as final and binding as it relates to this Survey.
